Terms and Conditions for Subscription to Planting and Maintenance of an Apple Tree at Bath Orchard Ltd.

1. Introduction 

These Terms and Conditions ("Terms") govern the subscription service provided by Bath Orchard Ltd ("we", "us", "our") for the planting and maintenance of an apple tree ("Tree") at our orchard. By subscribing, you ("Subscriber") agree to be bound by these Terms.

2. Subscription Service 

We will arrange for the planting and ongoing maintenance of an apple tree at Bath Orchard Ltd as part of your subscription. The scope of maintenance includes watering, pruning, and general care to promote healthy growth.

3. Ownership 

a. The Subscriber will not acquire ownership rights to the Tree or the land on which it is grown.

b. The Tree remains the property of Bath Orchard Ltd at all times.

c. The land on which the Tree is planted is also the property of Bath Orchard Ltd.

4. Rights and Use 

a. The Subscriber has the right to enjoy and view the Tree during the term of the subscription.

b. The Subscriber does not have any rights to transfer, sell, or otherwise dispose of the Tree or land.

5. Duration and Cancellation

a. The subscription shall commence on the date of subscription confirmation and continue for the period specified at the time of sign-up.

b. Either party may cancel the subscription with a notice period of 30 days written notice.

c. In the event of cancellation, no ownership rights to the Tree or land will transfer to the Subscriber.

6. Liability 

a. Bath Orchard Ltd shall not be liable for any damage or loss arising from the growth, health, or condition of the Tree or land.

b. The Subscriber acknowledges that the Tree is subject to natural growth processes and external factors beyond our control.

7. Privacy 

We will handle your personal data in accordance with our Privacy Policy, which is available on our website.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

9. Miscellaneous 

a. Any modifications to these Terms must be made in writing and agreed by both parties.

b. If any provision is found invalid, the remaining provisions shall remain in effect.

By subscribing to the planting and maintenance service, the Subscriber confirms understanding and acceptance of these Terms and Conditions.
